2. Eligibility and Website Use

By using our website or purchasing our services, you agree to provide accurate information and comply with applicable laws.

Purchases and bookings must be made by individuals legally capable of entering into the relevant agreement or by an authorised parent, guardian or representative where appropriate.

Participation by minors in Erthe Life experiences requires prior approval and appropriate parental or guardian consent.

Some experiences may have additional age, health or participation requirements.

You must not use our website or services for unlawful, fraudulent or unauthorised purposes.

We may restrict access or decline a booking where there is a legitimate safety, legal or operational reason, subject to applicable law.

3. Products, Pricing and Availability

We aim to provide accurate product descriptions, images, specifications, prices and availability information.

Prices are displayed in the currency indicated at the time of purchase. Applicable taxes, shipping charges and other fees will be disclosed during checkout where required.

Prices and availability may change for future purchases.

Where a material pricing or listing error affects an order, we will contact the customer to explain the issue and discuss appropriate options, including cancellation and refund where required.

We may limit quantities or decline orders where reasonably necessary, including where stock is unavailable or an order appears fraudulent.

Any cancellation of an accepted order will be handled in accordance with applicable law.

Product photographs are provided to illustrate the items offered. Minor visual differences may occur due to lighting, manufacturing variations and screen settings.

4. Orders, Payments and Billing

Customers agree to provide accurate and complete billing, contact and delivery information.

Payment must be completed using an accepted payment method unless another arrangement has been agreed in writing.

For certain services, training programs or retreats, instalment payments or deposits may be available.

The relevant payment schedule and any additional conditions will be communicated before enrolment or booking.

We may use third-party payment providers to process transactions securely.

Customers should contact Erthe Life promptly if they identify an error in their order or payment information.

7. Classes, Workshops and Event Bookings

Places in Erthe Life classes, workshops and group experiences may be limited.

Bookings are confirmed once the required payment has been received and confirmation has been issued.

Participants are responsible for reviewing the event date, location, start time, preparation instructions and relevant participation requirements.

We encourage participants to arrive on time to allow for check-in, preparation and any required safety briefing.

Late arrival may affect participation where the session has already commenced or where entry would disrupt the group or compromise safety.

Any refusal of participation or changes to booking arrangements will be handled reasonably and in accordance with applicable law.

Event cancellation and transfer conditions are outlined in our Refunds, Returns & Cancellation Policy and any additional terms disclosed before booking.

8. Health, Safety and Participant Responsibility

Erthe Life offers experiences involving breathing techniques, movement, body awareness, bodywork, sound and other wellbeing practices.

Some practices may involve physical exertion, changes in breathing patterns, emotional experiences or sensory stimulation.

Not every practice is suitable for every individual.

Participants may be required to complete a health questionnaire or provide relevant information before participating.

Where appropriate, participants should seek advice from a qualified healthcare professional before taking part, particularly if they have an existing medical condition or uncertainty about suitability.

Participants agree to:

  • Provide accurate information relevant to safe participation.

  • Follow reasonable safety instructions from facilitators.

  • Communicate discomfort or concerns during a session.

  • Respect their own physical and emotional limits.

  • Inform facilitators if they wish to modify, pause or stop an activity.

Participation is voluntary, and participants may decline or stop an exercise at any time.

Erthe Life may modify or decline participation in a particular practice where reasonably necessary for safety.

Nothing in this section removes our obligation to provide services with due care and skill or limits rights that cannot lawfully be excluded.

9. Nature of Wellness and Educational Services

Erthe Life provides wellness, personal development and educational experiences.

Unless expressly stated otherwise, our services are not medical treatment, psychological therapy, psychiatric care or a substitute for professional healthcare.

Information shared through our website, classes, training and educational materials is intended for general education and wellbeing.

Individual experiences and outcomes may vary.

We do not guarantee specific physical, psychological, emotional, professional or therapeutic outcomes.

Any description of potential benefits should be understood in the context of the particular service and the evidence supporting those claims.

This section does not exclude applicable consumer guarantees, including the obligation to provide services with due care and skill.

10. Professional Training and Certification

Professional training programs may include online learning, practical workshops, supervised practice, mentorship, assessment and residential immersion components.

Specific course requirements will be provided through the relevant course description or enrolment agreement.

Enrolment in a training program does not automatically guarantee certification.

Where certification is offered, participants must satisfy the published requirements, which may include attendance, practical competency, assessment and completion of required learning activities.

Any accreditation, professional recognition or certification status will be described accurately in the relevant training information.

Participants are responsible for understanding any additional professional registration, insurance or regulatory requirements relevant to their intended practice.

Training deposits, withdrawal conditions and deferral arrangements are governed by the Refunds, Returns & Cancellation Policy and any lawful course-specific enrolment terms disclosed before purchase.

11. Private Sessions, Mentoring and Corporate Bookings

Private sessions and mentoring appointments are scheduled according to practitioner availability.

Customers agree to provide accurate booking information and reasonable notice of changes.

Private appointment cancellations and rescheduling are governed by the 24-hour notice arrangements described in our Refunds, Returns & Cancellation Policy.

Corporate sessions, customised workshops and private group bookings may be subject to separate written quotations and agreements.

Where separate terms apply, they will be communicated before the booking is confirmed.

12. Retreats and International Experiences

Retreats and multi-day experiences may involve third-party accommodation providers, venues, transport operators and other service providers.

Specific inclusions, exclusions, payment arrangements and cancellation conditions will be communicated before booking.

Unless expressly included, participants are responsible for arranging their own flights, travel documents, visas, personal insurance and other travel requirements.

Participants should review destination-specific travel and health requirements before departure.

Where Erthe Life arranges or supplies part of a retreat package, we remain responsible for meeting our obligations under applicable law.

We will communicate material changes to an experience and provide appropriate remedies where legally required.

13. Respectful Conduct and Safe Participation

Erthe Life is committed to providing a respectful and inclusive environment for participants, facilitators and staff.

We expect participants to respect personal boundaries, privacy, consent and reasonable instructions.

Harassment, intimidation, discrimination, threatening behaviour and deliberate disruption of an experience are not acceptable.

We may take proportionate steps to protect participants and facilitators, including modifying or ending an individual's participation where reasonably necessary.

Any removal from an event or service, and any associated refund or cancellation outcome, will be assessed in accordance with the circumstances, contractual obligations and applicable law.

14. Photography, Video and Testimonials

Photography or video recording may occasionally take place during Erthe Life experiences.

Where identifiable images, recordings or testimonials are intended for marketing or promotional use, appropriate consent will be sought.

Participants may advise our team if they do not wish to be included in promotional photography or recordings.

Personal information, images and testimonials will be handled in accordance with applicable privacy laws and our Privacy Policy.

Participants must respect the privacy of others and must not record or publish identifiable images or sensitive personal information about other participants without appropriate consent.

15. Intellectual Property and Educational Materials

Website content, training materials, course manuals, recordings, written resources, photographs, branding and other original materials provided by Erthe Life may be protected by copyright and other intellectual property rights.

Unless expressly agreed otherwise, customers and training participants receive a limited, personal, non-transferable licence to use purchased educational materials for their intended learning purposes.

Materials must not be copied, redistributed, sold, published or represented as another person's original work without appropriate permission.

Completion of a training program does not transfer ownership of Erthe Life's intellectual property.

Participants may apply skills and knowledge acquired through training in their own professional practice, subject to applicable law and any clearly disclosed licensing conditions.

16. Third-Party Platforms and External Links

Our website may include links to third-party websites, booking platforms, payment providers and other services.

These may include Shopify, Eventbrite, Humanitix and other authorised providers.

Third-party services may operate under their own terms and privacy policies.

We encourage customers to review those conditions before using an external platform.

Erthe Life is not responsible for independent third-party content or services beyond the extent required by applicable law.

Where a third party is used to process an Erthe Life booking or purchase, the use of that platform does not remove statutory rights or obligations.

17. Customer Reviews and Submitted Content

Customers may submit reviews, testimonials, feedback or other content through our website or associated platforms.

Submitted content must be lawful, accurate to the best of the contributor's knowledge and respectful of others.

Customers must not submit content that infringes another person's rights, discloses private information without permission or contains malicious material.

Where customers voluntarily provide a review or testimonial, we may request permission to reproduce it for promotional purposes.

We will not knowingly misrepresent customer experiences or publish fabricated testimonials.

18. Privacy and Personal Information

We respect the privacy of our customers and participants.

Personal information collected through purchases, bookings, enquiries and service delivery will be handled in accordance with our Privacy Policy and applicable privacy laws.

Health information collected for participation screening will be handled with appropriate care and confidentiality.

Please review our Privacy Policy for information about how personal information is collected, used, stored and disclosed.

19. Australian Consumer Law

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.

These guarantees may include requirements relating to acceptable quality, fitness for purpose, due care and skill, and supply within an agreed or reasonable timeframe.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund, cancellation, repeat performance or compensation.

Nothing in these Terms of Service excludes, restricts or modifies any statutory rights or remedies that cannot lawfully be excluded.

20. Disclaimer and Limitation of Liability

We take reasonable care in preparing website information and delivering our products and services.

However, we do not guarantee that our website will always be uninterrupted or free from technical errors.

To the extent permitted by law, Erthe Life is not responsible for losses caused solely by circumstances outside our reasonable control or by a customer's unlawful or improper use of the website or services.

Nothing in these Terms excludes or limits liability for negligence, personal injury, consumer guarantee failures or other matters to the extent such liability cannot lawfully be excluded or limited.

Any limitation of liability will apply only to the extent permitted by applicable law.

21. Changes to Services and Terms

We may update website content, introduce new offerings or modify future product and service arrangements.

Where a customer has already entered into a confirmed booking or purchase agreement, material changes will be handled in accordance with the agreed terms and applicable law.

We may update these Terms of Service by publishing a revised version on our website.

Updates will not retrospectively remove rights or remedies applicable to existing transactions.

22. Suspension and Termination

We may suspend website access or decline further service where reasonably necessary due to fraud, unlawful conduct, serious breaches of these Terms or safety concerns.

Any action taken will be proportionate to the circumstances and subject to applicable law.

Termination does not remove payment obligations lawfully incurred before termination or statutory rights and remedies.

23. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

Nothing in this section excludes mandatory consumer protection rights or other laws that apply to customers in different jurisdictions.
